In these conditions, the following definitions apply:

• Member is a person registered as a member of Temmluxe.
• Clients are persons who are seeking services on the Temmluxe platform whether they do make a purchase or not.
• Service refers to the act by skilled individuals of completing work for someone else. For the purpose of these terms and conditions, only freelancers who have been verified (have a green tick displayed on their listing page on the Temmluxe platform) are classed as a service provider. 
• A seller is an individual who provides a service for the purpose of being purchased by others. 
• Membership refers to any individual who has created an account with Temmluxe and has subsequently bound themselves to all of the Temmluxe terms and conditions.
• A freelancer refers to a self-employed person who is not committed to a particular employer long-term.

• Website means the website located at www.luxefreelancers.com

1.0 General 

These conditions shall be binding upon a user’s acceptance of these terms following their account creation. These conditions are binding throughout the duration of your account and will cease to be effective upon deletion or termination of your account. You agree that your only rights and remedies under these conditions shall be against Temmluxe. 

Your membership is subject to the Temmluxe privacy policy which applies at all times in relation to any data that we collect. A waiver of any right under these conditions shall not be deemed to be a waiver of any subsequent breach or default. These conditions constitute the entire agreement and supersede any previous agreements. 

2.0 Agreement to Our Legal Terms 

We are Temmluxe ‘we’ ‘us’ or ‘our’, a company registered in the United Kingdom. We operate the website http://www.luxefreelancers.com (the ‘Site’). We provide a platform that connects skilled freelancers with clients who are seeking these services. These legal terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (‘you’) and Temmluxe concerning your access to and use of the services. You agree that by accessing the services, you have read, understood and agree to be bound by all of these legal terms.  

   3.0 Membership

3.1 Members Data 

As a member, you agree to keep your password confidential and will be solely responsible for any use of your account and password. We reserve the right to remove or change any username that is deemed as inappropriate through our sole discretion. Temmluxe reserve the right to suspend an account where it is reasonable to do so. This can be due to, but is not limited to a breach that is stipulated in section 6 of these terms and conditions. 

We will take all reasonable steps to ensure that your data is secure and managed in accordance with the luxe freelancers privacy policy. Note that all information that you provide to us is stored within our CRM servers. Any payment transactions completed through our selected third-party provider will be encrypted using Transport Layer Security Technology. 

You are under an obligation to continually provide accurate and up to date information relating to yourself when creating an account and throughout the entire duration of your membership as an individual using our services or as a freelancer providing services. Failure to provide correct information may lead to the termination of your account.  

3.2 Sellers

• Freelancers (sellers) agree to use Temmluxe for the sole purpose of providing a legal service to other members (buyers).
• Sellers must obtain a general liability insurance policy with a coverage amount sufficient to cover any risks associated with the performance of their service.

• All freelancer service listing applications are subject to acceptance by Temmluxe at its sole discretion. Application involves providing the following information :
• Step 1 : Curriculum Vitae (CV)
• Step 2: One reference
• Step 3: Proof of qualifications for specific roles.
• Temmluxe shall notify applicants in the event that his or her service listing application has not been accepted. Temmluxe are under no duty to disclose the reason as to why an application has been denied should this occur. In the event that an application is denied we encourage applicants to review the freelancer guidance.

3.3 Buyers 

• The services provided through Temmluxe are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the services.
• Buyers shall not offer direct payment to any sellers by using payment systems outside of the luxe freelancers platform 

• When placing an order, buyers may only use funds legally obtained and not directly or indirectly connected to any unlawful activities

4.0 Services 

4.1 Supply of services 

Services provided on our platform are classed as user generated content.  

• You acknowledge that Temmluxe reserve the right to accept commission upon the completion of services by a freelancer. 

• Services may be removed from our listing pages should they violate our terms or constitute misconduct or poor performance. 

• All services are required to have an appropriate and relevant image relating to the service being offered. Sellers have a duty to provide the same level of service as promoted in their listing. ‘Promoted’ in this instance refers to any descriptions and/or images featured on a listing in relation to a specific service. Any statements or descriptions relating to a service that undermines these terms and conditions is prohibited. 

4.2 Removal of services from the platform 

• Services that have been removed due to violations of these terms, are not able to be restored. It is not permitted for a user who has had their account terminated to create a new account under the pretence of another person or company. 

5.0 Orders 

5.1 Payments 

Once payment and services have been agreed, payment is made. Once a service has been delivered buyers are to mark the service as delivered on the platform. In the event that a buyer does not mark a service as having been completed, Temmluxewill automatically mark the service as complete after 3 days. After three days, a buyer continues to hold the right to dispute a service for any reasonable purpose. Further information about payments for orders can be found in our payment terms. 

5.2 Order Management 

Once an order has been placed, buyers will be notified through the email they have chosen to sign up with. Sellers are required to complete their order in the time specified and agreed upon when the order was placed by a buyer, unless unforeseen or exceptional circumstances prevent this from occurring.  

Temmluxe does not take responsibility and does not provide any guarantee of the quality of service provided by freelancers. Temmluxe also does not provide protection for members or freelancers who communicate outside of the Temmluxe platform.

5.3 Full Refunds/Partial Refunds

Buyers who would like to request a partial or full refund are to contact the freelancer directly by visiting their dashboard and requesting a partial or full refund. For further enquiries clients are encouraged to visit the enquiries page.

5.4 In-person meeting 

Where buyers and sellers are required to meet in person to perform a service, Temmluxe do not guarantee or take responsibility for the behaviour, capability or conduct of both sellers and buyers. Sellers and buyers consent to the risk being solely with themselves when meeting in person and that Temmluxe cease to have any liability in relation to this. 

6.0 User Conduct 

6.1 General 

Temmluxe aims to cultivate a professional and friendly online environment for freelancers and clients to connect. Users are to maintain this environment by not engaging in any misconduct during their time on the platform. To report any user misconduct that is in violation of our terms, or to enquire about our misconduct terms please contact our customer support. 

6.2 Non-permitted behaviours 

We reserve the right, but no obligation to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Legal Terms, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your contributions to the platform. You may not access or use the Temmluxe services for any purpose other than that for which we make the services available. As a user of our service you agree not to : 

• Systematically retrieve data or other content from the services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us. 
• Trick, defraud or mislead us and other users, especially in any attempt to learn sensitive account information. 
• Use any information obtained from the services in order to harass, abuse or harm another person. 
• Use the services in a manner inconsistent with any applicable laws or regulations 
• Attempt to impersonate another user or person or use the username of another user.
• Attempt to bypass any measures of the services designed to prevent or restrict access to the services, or any portion of the services. 
• Promoting services that are spam, nonsense, violent, offensive, of low quality or misleading to buyers or others.
• Reselling or mimicking the services of another user or users. 

6.4 Non-permitted Usage 

Users may not engage in any of the following behaviours when using our platform : 

• Privacy and identity – Any personal or confidential information freelancers have access to shall not be used other than to aid in the completion of a service requested through the luxe freelancer platform. Freelancers may not share any private information relating to any client both within the platform or outside of the platform. Any user that violates this term will be removed from the platform.  

• Authentic profiles – Profile images and information relating to users must be accurate and not misleading. Freelancers profile information  including any descriptions, skills or locations must be accurate and not misleading. 
• Unlawful use – You may not use Temmluxe for any unlawful or illegal activities. 
• Multiple Accounts – Users are limited to one account and are not permitted to create additional accounts using new information. Multiple account creation may result in your account being disabled or permanently suspended. 

6.3 Reporting violations 

Any perceived violations of our terms and conditions should be reported to us through enquiries@luxefreelancers.com. Any decisions made by Temmluxe following a reported violation may rely on the information that is provided by the complainant. Information relating to an investigation relating to a violation of our terms will not be shared. Any misuse of our reporting system may result in permanent removal of a user’s account. 

7.0 Electronic Communications 

7.1 Guidelines for Reviews 

When posting a review as a member you must comply with the following criteria; (1) You should have firsthand experience with the person and their services that are being reviewed. (2) your reviews should not contain offensive profanity, or abusive, racist, offensive, or hateful language; (3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability; (4) you may not post any false or misleading statements; and (8) you may not organise a campaign encouraging others to post reviews, whether positive or negative. Reviews will not be removed unless any of these terms are violated. 

We may accept,reject and remove reviews at our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review.

7.2 Messaging on the platform 

All criteria referred to in 6.1 are applicable to personal conversations when using the Temmluxe messaging system.

Any exchange of personal information for the purpose of fulfilling a service request may only be exchanged within the platform. Any information exchanged beyond the luxe freelancer platform is shared at users own discretion. Temmluxe do not provide any protection for and are not responsible for users who choose to share personal information outside of the platform. 

Improper language that is discriminatory, rude, abusive or that incites violence or threatening messages or inappropriate language may result in permanent deletion of your account. By agreeing to these terms you also agree to not discriminate against others based on specific factors such as race, religion, sexual orientation, gender or otherwise. Any form of spamming or soliciting sellers to alter or remove reviews is also not permitted. 

8.0 Term and Termination 

These legal terms shall remain in full force and effect while you use the services. Without limiting any other provision of these legal terms, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the services (including blocking certain IP addresses), to any person for any reason or for no reason, including without limitation for breach of any representation contained in these legal terms or of any applicable law or regulation. We may terminate your use or participation in the services or delete your account and any content or information that you posted at any time, without warning, at our sole discretion. 

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal and injunctive redness. 

These legal terms are governed by and interpreted following the laws of the United Kingdom, and the use of the United Nations Convention of Contracts for the International Sales of Goods is expressly excluded. 

9.0 Dispute Resolution 

We encourage users to manage disputes between themselves informally or formally through arbitration. If this is unsuccessful for any reason, users can contact customer support at enquiries@luxefreelancers.com for further assistance.

10.0 Confidentiality 

As sensitive information such as property addresses and contact details are required to fulfill services, sellers agree not to disclose such sensitive information to any third party. Sellers are to treat sensitive information as classified material and are not to use client’s personal information for any other purpose other than to fulfil a service request. Sellers are not to reproduce or copy clients information without the consent of a client. 

11 Limitation of Liability 

TO THE FULLEST EXTENT ALLOWED BY LAW, TEMMLUXE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (1) YOUR ACCESS TO OR USE4 OF OR INABILITY TO ACCESS OR USE THE SERVICES (2) ANY CONDUCT OR CONTENT OF ANY USERS OF THE SERVICES (3) UNAUTHORISED ACCESS OR USE OF PERSONAL SENSITIVE INFORMATION.

THE LIMITS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT TEMMLUXE HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

12. Future changes to these terms 

Temmluxe may change these terms occasionally. Any changes will be made available to view on this page. All users of Temmluxe will be notified via email should these terms and conditions be changed or updated.
